Applicability: PHI Health App | Health, Wellness, Step Tracking, Healthy Days, Rewards and Related App Features
1.Introduction and Scope
These Terms and Conditions govern your access to and use of the PHI Health App, including the health, wellness, engagement and app-specific features, communications and functionality made available by Prudential HCL Health Insurance Limited, a company incorporated in India having CIN: U65120MH2025FLC457866 and registered office at Suite 6, 48th Floor, Commerz III, International Business Park, Oberoi Garden City, Off Western Express Highway, Goregaon (East), Mumbai - 400063, referred to in these Terms as “PHI”, “we”, “us” or “our”. By accessing, registering for or using the PHI Health App, you agree to be bound by these Terms, PHI’s Privacy Policy, applicable consent notices, app-store terms, programme rules, feature-specific terms, and any additional notices or terms displayed or accepted within the PHI Health App.
These Terms apply only to the PHI Health App and any app-specific features, integrations, notifications, permissions, rewards, wellness journeys, health calculators, educational content, account features and related app functionality that PHI makes available from time to time. They do not apply to PHI’s corporate website, Buy Online insurance purchase journey, PruServices customer self-service portal, WhatsApp servicing platform, AI-enabled chatbot, virtual assistant or any other PHI digital platform, unless PHI expressly states otherwise. Those channels may be governed by their own separate terms and conditions. If there is any inconsistency between these Terms and the terms of an issued insurance policy, the policy wording, schedule, endorsements and applicable regulatory requirements will prevail for matters relating to insurance coverage, benefits, exclusions, waiting periods, claims, premiums, policy servicing and policyholder rights.
The PHI Health App may be made available to policyholders and, where enabled by PHI, to non-policy users or guest users for limited health, wellness, educational, calculator, engagement or other app features made available without linking an insurance policy. Guest access does not create, modify or evidence any insurance cover, policyholder relationship, entitlement to policy servicing, claim benefit, premium discount or other insurance-related right unless PHI expressly confirms otherwise through the applicable policy documents, programme rules or authorised PHI channel.
THE PHI HEALTH APP IS INTENDED TO OPERATE PRIMARILY AS A HEALTH AND WELLNESS APPLICATION. ITS FEATURES MAY INCLUDE STEP TRACKING, HEALTHY DAYS, WELLNESS JOURNEYS, HEALTH CALCULATORS, EDUCATIONAL CONTENT, REWARDS OR OTHER ANCILLARY HEALTH AND ENGAGEMENT BENEFITS MADE AVAILABLE BY PHI FROM TIME TO TIME. UNLESS PHI EXPRESSLY ENABLES AND COMMUNICATES A SPECIFIC FEATURE WITHIN THE APP, THE PHI HEALTH APP DOES NOT PROVIDE INSURANCE PURCHASE, POLICY SERVICING, CLAIMS, UNDERWRITING, PREMIUM PAYMENT, POLICY CHANGE, RENEWAL, GRIEVANCE REDRESSAL OR OTHER POLICYHOLDER TRANSACTION FUNCTIONALITY. ANY INSURANCE-RELATED SERVICING, TRANSACTION, CLAIM, POLICY CHANGE, PAYMENT, RENEWAL, COMPLAINT OR OTHER POLICYHOLDER REQUEST THAT IS NOT EXPRESSLY SUPPORTED WITHIN THE PHI HEALTH APP MUST BE COMPLETED THROUGH THE APPROPRIATE PHI CHANNEL, CUSTOMER PORTAL, CONTACT CENTRE, BRANCH, GRIEVANCE MECHANISM OR OTHER AUTHORISED SERVICING CHANNEL MADE AVAILABLE BY PHI AS COMMUNICATED TO YOU FROM TIME TO TIME.
2.Regulatory and Legal Context
PHI is a health insurer operating in India. The PHI Health App and its features are intended to be used in accordance with applicable Indian laws and regulatory requirements, including those relating to insurance, data protection, information technology, consumer protection, cybersecurity and related sectoral obligations. PHI may update the app, its disclosures, features, user journeys, risk controls and customer communications from time to time to reflect changes in law, regulatory guidance, technology, business requirements, security standards and customer servicing needs.
3.Definitions
In these Terms, unless the context requires otherwise: “Account” means a user profile or login created or used to access the PHI Health App. “App” or “PHI Health App” means the PHI mobile health and wellness application made available by PHI on Android, iOS or other authorised app distribution channels, including app-specific features, integrations, notifications, permissions, rewards, wellness journeys, health calculators, educational content, account features and related functionality. “Policy” means an insurance policy issued by PHI. “User”, “you” or “your” means any person accessing or using the PHI Health App, including policyholders, insured persons, covered members, authorised representatives and guest users where applicable. “Third Party Services” means services, platforms, devices, integrations, health or fitness platforms, wearable providers, analytics tools, communication providers, cloud services or other third-party systems used in connection with the PHI Health App.
4.Acceptance, Eligibility and User Responsibility
By registering, logging in, accepting these Terms, using OTP authentication, granting app permissions, using health, wellness, rewards or notification features, or otherwise accessing or using the PHI Health App, you confirm that you have read, understood and accepted these Terms. You must be legally competent to contract under Indian law. If you act on behalf of another person, you represent that you are duly authorised to do so and that the information you provide is true, complete and accurate.
Only persons who are legally competent to enter into a binding contract under applicable law may register for, access or use the PHI Health App. Where any person on whose behalf the App is used, including a covered member, minor or other person who is not legally capable of acting independently under applicable law, all registrations, declarations, consents, acknowledgements and acceptances of these Terms must be made by such person’s parent, legal guardian or other duly authorised representative acting on their behalf. This clause applies only where the relevant person does not have legal capacity to undertake such actions independently under applicable law and should not be read as implying that all persons with disabilities lack legal capacity.
You are responsible for maintaining the confidentiality of your login credentials, device access, OTPs, passwords, registered mobile number, email account and authentication information. OTPs may expire, repeated OTP requests or failed login attempts may be rate-limited, and PHI may require re-authentication, restrict simultaneous sessions, bind access to a verified device or apply similar controls where reasonably required for authentication, fraud prevention, account security, reward integrity, platform compliance or operational control. Any activity conducted through your credentials or registered device may be treated as authorised by you unless PHI is notified of unauthorised use in accordance with its prescribed process. You must not share OTPs, passwords or sensitive account information with any person claiming to represent PHI unless you have verified the authenticity of the request through official PHI channels.
You are responsible for making all arrangements necessary to access the PHI Health App, including internet connectivity, compatible devices, software, security settings and telecommunications services. You are also responsible for ensuring that any person who accesses the PHI Health App through your device, connection, credentials or account is aware of these Terms and complies with them.
5.Accuracy of Information, Proposal Submission and Misrepresentation
You must provide accurate, complete, current and truthful information when using the PHI Health App, including while registering, updating account details, linking a policy where supported, using health and wellness features, granting permissions, participating in rewards or engagement programmes, or contacting app support. PHI may rely on the information, permissions and activity data linked to your account for app operation, wellness features, reward calculations, fraud prevention, security and customer support. Any suppression, misstatement, misrepresentation, impersonation, fraud, false declaration or failure to provide accurate information may affect your access to the App, rewards, healthy-day calculations, app-linked benefits or any remedies available to PHI under applicable law and relevant terms.
6.Policy Documents and Non-App Servicing Clarification
The PHI Health App is not intended to operate as a general insurance purchase, proposal submission, underwriting, premium payment, renewal, claims or policy servicing platform, except to the limited extent that PHI expressly enables and describes a specific feature within the App and these Terms. Any insurance-related purchase journey, proposal submission, KYC, premium payment, renewal, claim, grievance, policy change or other policyholder transaction that is not expressly supported within the PHI Health App must be completed through PHI’s authorised channels, including PHI’s official website, customer portal, contact centre, branch, grievance mechanism or any other channel communicated by PHI from time to time.
Your insurance policy, if any, is governed by the applicable policy wording, schedule, endorsements, proposal form, benefit illustration, customer information sheet, programme rules and applicable insurance regulations, and not by these Terms. Nothing shown in the PHI Health App, including wellness content, healthy-day progress, reward indications, policy references, member details, calculator outputs or app notifications, varies, extends, replaces or overrides the terms of any insurance policy or any formal communication issued by PHI.
7.Verification, Security and Misuse Prevention
PHI may verify your mobile number, account details, device information, app permissions, policy-linking information where supported, activity data and related records through internal systems, service providers, platform providers or other lawful sources for authentication, security, fraud prevention, misuse detection, reward integrity, app support, regulatory compliance and operational control purposes. PHI may suspend or restrict access to the App, rewards or related features where verification is incomplete, inconsistent, suspicious, technically unsupported, legally restricted or where additional verification is required due to triggered security controls.
8.App Support, Limited Policy Reference Information and Digital Records
Where enabled by PHI, the PHI Health App may allow you to view limited account, policy reference, member, reward, healthy-day, wellness or notification information, or to contact app support. These features are provided for convenience and wellness engagement only and do not alter the terms of any policy, the claim process, documentation requirements, admissibility assessment, exclusions, sub-limits, waiting periods or other policy conditions. Claims, policy changes, renewals, grievances and other policyholder transactions must be completed through the authorised PHI channels communicated to you, unless a specific feature is expressly supported within the App.
Electronic records, timestamps, system logs, OTP validations, consent records, permission records, IP information, device information, activity sync records, communication records and digital acceptance records maintained by PHI or its service providers may be used for verification, audit, compliance, dispute resolution, fraud prevention, app support, reward integrity and evidentiary purposes, subject to applicable law.
9.Notifications and App Communications
PHI may communicate with you through push notifications, in-app messages, SMS, email or other app-linked communication modes for account, security, consent, wellness, rewards, educational, service, support, regulatory or informational purposes, subject to applicable law and your communication preferences, including consent and opt-out choices where required. If you decline optional notification permissions, you may not receive push notifications, but the App may continue to function where technically possible.
Communications may be affected by network delays, platform limitations, device settings, internet availability, message previews, shared device risks and third-party terms. You should not use the PHI Health App, app communications or notification features for emergencies or urgent medical assistance.
10.Health App, Wellness and Fitness Features
The PHI Health App may include wellness features, fitness tracking, step counting, healthy days, health challenges, BMI calculators, health scores, educational content, preventive health information, goal tracking, reward mechanisms, wellness journeys, Health Connect integration on Android, Apple Health or Apple Fitness integration on iOS, wearable integrations, guest access and other app-based health and engagement capabilities made available by PHI from time to time. These features are provided for general wellness, engagement and informational purposes only. They do not constitute medical advice, clinical advice, diagnosis, treatment, prescription, healthcare recommendation, emergency assistance or a substitute for consultation with qualified healthcare professionals. The PHI Health App is not a medical device and is not intended to diagnose, prevent, monitor, treat, cure or manage any disease, injury, disability or medical condition.
Health scores, BMI values, step counts, activity data, goals, rewards and similar outputs may depend on user inputs, device sensors, third-party platforms, wearable accuracy, software versions, internet connectivity, permissions and data synchronisation. PHI does not guarantee that such outputs are complete, accurate, medically validated, suitable for your health condition or available at all times. You should consult a qualified healthcare professional before making any health, fitness, diet, treatment or lifestyle decision, especially if you have a medical condition, are pregnant, are undergoing treatment or experience symptoms.
Step tracking, activity tracking and related health or fitness features may depend on the permissions you grant to Health Connect on Android, Apple Health or Apple Fitness on iOS, your device operating system, device sensors, wearables, third-party platforms, connectivity and data synchronisation. PHI will request access only to health, fitness, activity, device or integration data that is reasonably necessary for enabled user-facing App functionality, such as step tracking, healthy-day calculation, wellness journeys, reward operation, fraud prevention, misuse detection, security, support or other functionality described in the App, PHI’s Privacy Policy or applicable consent notices. Google, Apple, wearable providers and other platform providers may process your data under their own terms, privacy notices, platform rules and permission settings, independently of PHI. PHI does not guarantee that step counts, distance, exercise, sleep or other activity data shown on the health app will exactly match your actual activity, and differences between devices, platforms, wearables or data sources may occur.
You may withdraw health, fitness or related device permissions at any time through your device settings, including Health Connect settings on Android or Apple Health or Apple Fitness settings on iOS. If you withdraw such permissions, syncing may stop and you may stop earning healthy days, rewards or receiving certain wellness feature outputs, although the rest of the app may continue to function where technically possible. Data already synced will remain subject to PHI’s Privacy Policy, applicable consent notices, retention requirements and applicable law.
Where enabled and consented to by you, the health app may collect or use a location snapshot, including precise device location where applicable, during background step syncing or related wellness activity validation for fraud prevention, misuse detection, service integrity and operational control purposes. Further details will be provided in PHI’s Privacy Policy and applicable consent notices.
PHI does not sell health or fitness data obtained through Apple Health, HealthKit, Health Connect, wearable integrations or similar platform integrations. PHI will not use such data for advertising or unrelated profiling. Health data obtained through Apple Health, HealthKit, Health Connect or similar integrations will not be used for advertising, marketing, marketing analytics, data mining or any purpose unrelated to providing the user-facing health, wellness and app functionality requested by the user. PHI may share such data with third parties only where necessary to provide the app features requested by you, operate wellness or reward features, comply with law, support app security and integrity, prevent fraud or misuse, or as otherwise described in PHI’s Privacy Policy and applicable consent notices.
Apple, Google, wearable providers and other platform providers are not parties to these Terms and are not responsible for the PHI Health App, PHI’s wellness programme, rewards, content, app support, data processing by PHI or any obligation owed by PHI to you, except to the extent expressly stated in their own terms or required by applicable law.
11.App Licence and Acceptable Use Restrictions
We grant you a personal, non-transferable, non-exclusive, revocable licence to use the app for your own non-commercial purposes in accordance with these Terms. All rights not expressly granted are reserved.
You agree not to:
- copy, modify, reverse-engineer, decompile or create derivative works from the app, except to the extent permitted by applicable law or by an applicable open-source licence;
- tamper with or circumvent any security technology in the app, or interfere with its proper working;
- scrape, harvest or bulk-extract data from the app or its APIs, or access them by any automated means we have not authorised;
- falsify, simulate or artificially inflate step or activity data, or otherwise game the healthy-days or discount programme;
- register more than one account, impersonate anyone, or use the services to send spam or unsolicited messages;
- use the app for any unlawful purpose, or in breach of any applicable law or regulation; or
- use the app, APIs, Apple Health, Health Connect, wearable integrations or platform permissions in a manner that violates Apple, Google or other third-party platform rules, including by attempting to access more data than required, bypassing permission flows, or using health data for advertising or unrelated purposes.
We may monitor use of the app to verify compliance with these Terms and to protect the reward programme, and we may limit or deny access where we reasonably suspect abuse. Uninstall the app and log out before selling or giving away your device.
12.Rewards, Challenges and Engagement Programmes
PHI may introduce rewards, wellness points, engagement programmes, challenges, badges, incentives, discounts, vouchers or similar benefits. Such programmes may be subject to additional terms, eligibility criteria, validity periods, usage conditions, partner availability, regulatory requirements and PHI’s discretion. Rewards are not guaranteed unless expressly confirmed by PHI and may be modified, withdrawn, suspended or discontinued. Participation in a wellness or rewards programme does not guarantee policy issuance, claim approval, premium reduction, medical benefit or health outcome.
13.AI-Enabled Chatbots, Virtual Assistants and Automated Digital Assistance
PHI may make automated or app-based assistance features available within the PHI Health App from time to time for limited help, navigation, wellness, support or informational purposes. You acknowledge that certain responses, summaries, prompts, recommendations or outputs may be generated automatically and may not always be complete, accurate, current or suitable for your specific circumstances.
Automated or app-based assistance outputs do not constitute medical advice, clinical advice, healthcare advice, insurance advice, underwriting decisions, claim decisions, financial advice, legal advice or any binding commitment by PHI. Such outputs are provided for general assistance only and do not override the policy wording, policy schedule, endorsements, benefit illustration, customer information sheet, proposal form, official communications issued by PHI, or any decision formally communicated by PHI. You should independently verify important information through official PHI documents, authorised representatives or qualified professionals before acting on it.
PHI may modify, restrict, suspend or discontinue any automated or app-based assistance features at any time. You must not input unnecessary sensitive information, confidential third-party information, unlawful content, abusive content, medical emergencies or instructions intended to manipulate, test, reverse engineer or misuse such features. PHI may use permitted information, de-identified data, aggregated data, feedback and interaction metadata for quality monitoring, analytics, safety testing and service improvement in accordance with applicable law and its privacy notices.
14.Website Content, Educational Material and No Professional Advice
Content in the PHI Health App may include wellness content, health calculators, educational articles, FAQs, reminders, explainers and general information. Some content may be provided by or based on information received from third parties. Such content is provided for convenience, awareness and wellness engagement only, may be changed or updated without notice, and should not be treated as medical, clinical, legal, tax, financial, investment, insurance or other professional advice. You must not rely on the App, health scores, calculators, activity data, automated outputs, wellness content, notifications or rewards as a substitute for professional medical advice, clinical assessment, diagnosis, treatment or emergency care. While PHI takes reasonable care in making information available, PHI does not guarantee its accuracy, completeness, timeliness or suitability. You should independently verify important information before acting on it. Product benefits, exclusions, premiums, waiting periods, claim conditions and policyholder rights are governed by the applicable policy documents and regulatory requirements.
15.No Emergency Services
The PHI Health App and any app-based wellness, notification, support or assistance features are not emergency medical services. If you believe you are experiencing a medical emergency, you should immediately contact emergency services, visit the nearest hospital or consult a qualified medical practitioner. PHI is not responsible for delays, errors or consequences arising from reliance on the App for emergency assistance.
16.Privacy Policy, Cookies and Data Protection
PHI processes personal data in accordance with applicable data protection laws, consent notices, privacy notices and PHI’s separate Privacy Policy. The Privacy Policy explains how PHI collects, uses, stores, shares, protects and otherwise processes personal data in connection with the PHI Health App, including account creation, OTP login, device information, app permissions, notifications, Health Connect, Apple Health, wellness features, activity tracking, healthy days, rewards, analytics, diagnostics, security and customer support.
Please refer to PHI’s Privacy Policy at https://www.prudentialhealth.in/privacy-policy. Your use of the PHI Health App may also be subject to specific consent notices, privacy notices, operating-system permission prompts or preference choices presented at the relevant point of collection or use.
Nothing in these Terms limits any rights you may have under applicable data protection laws or PHI’s Privacy Policy. If you withdraw consent or disable permissions, PHI’s ability to provide the related App feature, such as step syncing, healthy-day calculation, rewards, notifications, analytics or support, may be affected where the relevant processing is necessary. You may request deletion or closure of your PHI Health App account through the process made available by PHI in the App, on its official website or through customer support. Account deletion may affect access to app features, healthy-day records, rewards, activity history and linked wellness functionality. PHI may retain certain records where required or permitted under applicable law, insurance regulations, audit requirements, fraud prevention, security, dispute resolution, legal claims, regulatory reporting, policy administration or other lawful purposes described in PHI’s Privacy Policy and applicable notices.
17.Third-Party Platforms, Partners and External Links
PHI may use or integrate with third-party platforms and service providers in connection with the PHI Health App, including Health Connect, Apple Health, Apple Fitness, wearable device providers, device operating systems, cloud providers, analytics providers, crash-reporting tools, communication service providers, notification services and other technology partners. Third Party Services may be governed by their own separate terms, privacy notices, acceptable use policies, permissions, technical requirements and operating procedures. You should review and understand the applicable third-party terms and policies before using such services or authorising access through them. PHI does not control all third-party systems and is not responsible for their independent acts, omissions, downtime, accuracy, availability, security incidents or content except to the extent required under applicable law or contractual obligations.
Links to external websites or third-party resources are provided for convenience only and do not imply endorsement unless expressly stated. You should review the applicable terms and privacy notices before using third-party platforms or sharing information with them.
Your use of the PHI Health App through the Apple App Store, Google Play Store or any other authorised app distribution platform may also be subject to the applicable platform terms, store requirements, developer policies and technical requirements. To the extent required under such platform requirements, the relevant platform provider may enforce those platform-specific requirements directly against users.
18.Prohibited Activities
You must not misuse the PHI Health App. Prohibited activities include unauthorised access, impersonation, fraud, false declarations, manipulation of step, activity or reward data, interference with app security, reverse engineering, scraping, automated extraction, malware introduction, denial-of-service activity, unauthorised use of APIs, infringement of intellectual property, uploading or sharing content that belongs to another person without authority, unlawful content, obscene, sexually explicit, indecent or otherwise inappropriate content, content harmful to minors, abusive or harassing content, phishing, social engineering, attempts to bypass authentication, misuse of automated or app-based assistance features, or any activity that violates applicable law, PHI policies, these Terms, third-party rights or Apple, Google or other platform rules.
PHI may suspend, restrict or terminate access to the PHI Health App, rewards or related features, investigate activity, report suspected misconduct to authorities, preserve records or take legal action where it reasonably believes that a user has violated these Terms, applicable law, app security requirements, platform rules or PHI’s legitimate business interests.
19.Availability, Maintenance and Cybersecurity
PHI will endeavour to maintain reasonable availability, security and functionality of the PHI Health App. However, the App may be unavailable, delayed, interrupted, degraded or restricted due to scheduled maintenance, emergency maintenance, system upgrades, technical failures, bugs, viruses, cyber incidents, internet outages, third-party downtime, force majeure events, regulatory directions, security controls, operating-system changes, app-store requirements, unsupported app versions or operational reasons. PHI does not guarantee uninterrupted, error-free, virus-free or fully secure access to the App. You may be required to install updates to continue using the PHI Health App or certain features.
You are responsible for using updated devices, secure networks, genuine software, anti-malware tools and safe digital practices. You should not use the PHI Health App on a rooted, jailbroken, tampered, compromised or insecure device, or where operating-system security controls have been bypassed. PHI may restrict access, syncing, rewards or related functionality where it reasonably detects device compromise, emulator use, automation, tampering, unauthorised modification, abnormal activity or other security risk. PHI is not responsible for losses arising from compromised devices, shared devices, weak passwords, user negligence, phishing, unauthorised disclosure of OTPs, insecure networks or third-party malware.
You must not knowingly introduce viruses, trojans, worms, logic bombs, malicious code or technologically harmful material, attempt to gain unauthorised access to any PHI system, server, database or connected system, or attack the PHI Health App through a denial-of-service or distributed denial-of-service attack. PHI may report suspected cyber misuse, unlawful access or technology offences to appropriate law enforcement or regulatory authorities and may cooperate with such authorities in accordance with applicable law. In such cases, your right to access or use the App may cease immediately.
20.Intellectual Property and User Content
All rights in the PHI Health App, content, design, software, text, graphics, logos, marks, trade names, product names, interfaces, databases, workflows, documentation and other materials are owned by or licensed to PHI and are protected by applicable intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the App for lawful personal, non-commercial wellness and app-related purposes in accordance with these Terms. All other use, reproduction, modification, distribution or commercial exploitation is prohibited without prior written permission.
If you submit feedback, suggestions, ideas, reviews, comments, images or other content through the PHI Health App, you represent that you have the right to do so and grant PHI a lawful, worldwide, royalty-free licence to use, reproduce, process, store, analyse, display, adapt and act upon such content for app operation, support, security, compliance, analytics, improvement, dispute resolution and other lawful business purposes, subject to applicable privacy obligations.
21.Disclaimers and Limitation of Liability
To the maximum extent permitted by applicable law, the PHI Health App is provided on an “as is” and “as available” basis. PHI disclaims all warranties not expressly provided by law or contract, including implied warranties of accuracy, completeness, merchantability, fitness for a particular purpose, uninterrupted availability, non-infringement and error-free operation. PHI does not warrant that app content, automated outputs, wellness data, device integrations, third-party data, calculators, reward indications or App results will be complete, accurate, current, reliable or suitable for your personal circumstances.
To the maximum extent permitted by law, PHI will not be liable for indirect, incidental, special, punitive, exemplary, remote or consequential damages, loss of profit, loss of opportunity, loss of data, loss of goodwill, business interruption, device damage, third-party failure, unauthorised access due to user negligence, or reliance on non-binding app content, wellness outputs, activity data, reward indications or automated responses. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, any liability that cannot be excluded or limited under applicable law, or statutory rights of policyholders under applicable insurance regulations.
22.Indemnity
You agree to indemnify and hold harmless PHI, its directors, officers, employees, agents, affiliates, service providers and representatives from and against claims, losses, liabilities, damages, penalties, costs and expenses arising from your breach of these Terms, misuse of the PHI Health App, reliance on health-related, wellness or educational content contrary to these Terms, unauthorised access, fraud, misrepresentation, violation of law, infringement of third-party rights, misuse of automated or app-based assistance features, submission of false or unlawful content, manipulation of activity or reward data, or unauthorised actions taken through your account, device or credentials.
23.Changes to Services, Future Functionality and Beta Features
PHI may introduce, modify, enhance, restrict, suspend, migrate or discontinue any PHI Health App feature, wellness capability, reward feature, integration, communication channel, mobile app feature or beta functionality at any time. Future or beta features may be experimental, limited, incomplete, subject to change and governed by additional terms. PHI may restrict, disable or discontinue older or unsupported App versions where required for security, compatibility, legal, regulatory, app-store, platform, operational or service-integrity reasons. Some features may not function correctly if you use an outdated operating system, unsupported device, disabled permissions or an older App version. Continued use of the App after changes are published or notified constitutes acceptance of the updated terms, unless a separate consent or acceptance is required by law.
PHI reserves the right to vary, amend or replace these Terms at any time by publishing the updated version through the PHI Health App, PHI’s official website or otherwise notifying users where required. You are advised to review these Terms periodically. Your continued access to or use of the App after updated Terms are published or notified will be treated as acceptance of the updated Terms, unless a separate consent or acceptance is required by applicable law.
24.Prudential Name and Brand Disclaimer
Prudential HCL Health Insurance Limited is a joint venture company owned in part by an indirect subsidiary of Prudential plc of the United Kingdom. Prudential HCL Health Insurance Limited and Prudential plc are not affiliated in any manner with Prudential Financial, Inc., a company whose principal place of business is in the United States of America, or with The Prudential Assurance Company Limited, a subsidiary of M&G plc, a company incorporated in the United Kingdom.
25.HCL Name and Brand Disclaimer
Prudential HCL Health Insurance Limited uses the “HCL” name and related brand references pursuant to appropriate rights, permissions or arrangements. Unless expressly stated otherwise, any reference to “HCL” in connection with PHI is intended only to identify PHI’s association with the HCL group as a shareholder, promoter, joint venture participant or strategic partner, as applicable. PHI is a separate legal entity and is solely responsible for the PHI Health App, its wellness features, app support and any insurance products or policyholder obligations issued or undertaken by PHI. No HCL group company, affiliate, associate, promoter entity, director, officer or employee shall be deemed to be an insurer, insurance intermediary, guarantor, underwriter or provider of PHI’s insurance products or services solely by reason of the use of the HCL name, brand or association, unless expressly required under applicable law or specifically stated in writing.
26.Grievance Redressal and Complaints
You may raise questions, complaints or concerns relating to the PHI Health App, app permissions, wellness features, rewards, privacy matters or app support through the channels specified by PHI in the App, on its official website, in privacy notices or in customer communications. Policy-related complaints, claims grievances, renewals, policy changes and other policyholder matters must be raised through PHI’s authorised grievance and servicing channels communicated from time to time, unless a specific App feature is expressly made available for that purpose. PHI may designate grievance officers, nodal officers, data protection contacts or other responsible personnel as required under applicable law. If you are dissatisfied with PHI’s response, you may use escalation mechanisms available under applicable insurance, consumer protection or data protection frameworks, including relevant regulatory complaint channels where applicable.

27.Force Majeure
PHI will not be responsible for failure or delay in performance caused by events beyond its reasonable control, including natural disasters, epidemics, pandemics, acts of government, regulatory directions, war, terrorism, civil unrest, labour disruptions, power failures, internet outages, cyberattacks, third-party platform failures, app-store disruptions, operating-system changes, cloud service outages or other force majeure events.
28.Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to applicable statutory remedies and regulatory complaint mechanisms available to policyholders and customers, the courts at Mumbai, Maharashtra shall have jurisdiction over disputes arising from or relating to these Terms or your use of the PHI Health App.
29.Severability, Entire Agreement and Survival
If any provision of these Terms is found invalid, unlawful or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law. These Terms, together with applicable privacy notices, consent notices, programme rules and additional app-specific terms, constitute the agreement governing your use of the PHI Health App. They do not replace or override any insurance policy documents, product terms, proposal forms, policy wording, schedules, endorsements or regulatory rights that may apply to your insurance relationship with PHI. Provisions relating to intellectual property, privacy, records, disclaimers, limitation of liability, indemnity, governing law, jurisdiction and dispute resolution will survive termination or discontinuation of access.
